Position to join Hansel Henson as a Trade Mark Attorney

We are seeking a 2- 4 year qualified Trade Mark Attorney to join our busy team, in a Central London firm of solicitors. This role would suit an ambitious individual who is looking to develop their skills and experience in a dynamic, supportive and fun environment.  The successful candidate will enjoy drafting and doing high quality work with a range of clients, but with a particular focus on tech and consumer brands. 

This role is intended to be office based, with flexibility to work from home as needed depending on current government guidance.  Our office is modern, spacious and well equipped and located a few minutes from Tottenham Court Road tube and the British Museum. 

About The Firm 

Hansel Henson is a firm of solicitors specialising in Intellectual Property and Media. The firm is recognised in both the Chambers and Legal 500 directories for both these complementary areas of work despite having only been set-up in 2009. 

The firm currently consists of four Partners, two further Solicitors and a Trainee Solicitor, two Consultants and a Trade Mark Paralegal. Justine Flockhart is the Partner with overall responsibility for trade marks and David Lutkin is a very experienced Trade Mark Attorney who is a Consultant to the firm.  You will be supported by the Trade Mark Paralegal and a junior paralegal. 

Our clients range from household names down to start-ups, and are in a wide range of sectors, though the firm has a particularly strong digital media practice and in consumer facing fields such as fashion, retail and the like. It is a friendly, forward looking firm, doing really interesting work! 

The firm has a busy trade mark portfolio and it is very active in filing UK applications and International filings through the Madrid Protocol.  The portfolio is international, both in terms of overseas clients and registrations overseas.  Our portfolio has grown significantly following Brexit. 

We cover trade mark prosecution work, oppositions/cancellations, maintenance, and trade mark clearance searches. 

Additionally, the firm advises clients on the protection, exploitation and enforcement of other intellectual property rights, as well as media law and commercial contract drafting and other non-contentious work.  

Key Requirements 

Completed all of the Trade Mark Attorney qualification process and have at least 2yrs PQE experience, whether in private practice or an in-house trade mark department, together with the following skills: 

  • Knowledge of trade mark law and practice 
  • Knowledge of registered design rights  
  • Strong organisational skills 
  • Ability to work on multiple matters for different clients in any one day 
  • Ability to work to deadlines 
  • Strong attention to detail 
  • Good computer skills 
  • Ability to work independently and as part of a team 
  • Great interpersonal and communication skills  
  • Keen to learn and progress 
  • Keen to develop client relationships and business development 
  • Knowledge of WebTMS is desirable 
  • Experience of preparing and submitting takedowns on various platforms desirable 

Job details 

The job will include the following: 

  • Advising on trade mark, design rights, and domain name matters 
  • Strategic advice on trade mark filings and portfolio structure on an international basis and providing costings in relation to the same 
  • Carrying out brand reviews and audits and reviewing and maintaining trade mark portfolios 
  • Preparing, filing and prosecuting trade mark applications including liaising with foreign agents where necessary 
  • Advising on and drafting responses to registry objections 
  • Advising on and preparing various recordals at the UKIPO  
  • Conducting trade mark searches, analysing results and preparing reports 
  • Advising clients on cancellations and infringement matters 
  • Drafting opposition and cancellations notices 
  • Drafting and preparing evidence and submissions for opposition and cancellation actions 
  • Preparing for registry hearings 
  • Drafting and negotiating undertakings, co-existence agreements and settlement agreements and handling inter partes disputes before trade mark registries generally  
  • Advising clients on renewal strategies, trade mark use and maintenance issues and handling renewals of trade mark and design registrations. 
  • Reviewing monthly watch services and reporting accordingly 
  • Marketing and development of our trade mark business and your own practice
